Volusia County's Fraternization Policy


VolusiaExposed.Com was recently made aware of the January 7, 2013 - HR BULLETIN 18 memorandum, from Volusia County Human Resource Director, Tom Motes. This memorandum was approved by Deputy County Manager, Charlene Weaver. Therefore, the mandates of Bulletin 18 appear to be applicable to all county divisions / department, including the Sheriff Department.

Within the last few months, Volusia County Government has experienced some rather disturbing fraternization complaints coming out of several divisions / departments of county government. VolusiaExposed.Com has posted some articles regarding these complaints, we have other articles pending.

Recently, even the Volusia County Sheriff's Department instituted their own
fraternization policy
, in apparent response to an anonymous complaint received by VolusiaExposed, and forwarded to the VCSO.

Assistant County Attorney Nancye Jones argued during VCBP Captain Rich Gardner's April 2012 County Personnel Board Hearing, that he was Officer Cara Gittner's supervisor, regardless of whether was / wasn't assigned to his direct supervision.



Assistant County Attorney Nancye Jones stated that the Capt. Gardner investigation was started over an anonymous allegation.



Assistant County Attorney Nancye Jones argued during the Gardner hearing that such departmental relationships are bad for the agency's morale.


Assistant County Attorney Nancye Jones again stated that the Captain Gardner investigation was started over an anonymous complaint.


Assistant County Attorney Nancye Jones argued that Captain Gardner's sexual relationships with subordinates caused the perception of favoritism within the Beach Patrol staff.



Conflicts of Interest

In section "C" of HR BULLETIN 18 it states, that department head(s) will assess the potential for any professional conflict of interest in respect to current assignments on a case by case basis".

As noted above, Bulletin 18 appears to be applicable in all divisions / departments within Volusia County government. VolusiaExposed.Com has long expressed concerns regarding a perceived conflict of interest between the County Legal and Sheriff departments.

Assistant County Attorney Nancye Jones handles many of the legal matters attached to the Sheriff Department, while her husband, Major Robert Jones is effectively third in command of the VCSO. According to the below listed, recently updated organizational chart, Major Jones is in charge of the "Law Enforcement Services" branch of the VCSO.

Recently, a Lt. Nardiello came under investigation for allegations that included, but were not limited to, harassment, and creating a hostile working environment. Some of the allegations against Lt. Nardiello were sustained, while others were not. Lt. Nardiello received a written reprimand.

Even given, Major Robert Jones' position within the VCSO, Assistant County Attorney Nancye Jones attended the Internal Affairs interview of Lt. Nardiello. (see bottom of page 9 of the below report)

While it appears to be a fact that Lt. Nardiello was not assigned to Major Jones' "Law Enforcement Services" section of the VCSO, Major Jones still out ranked Lt. Nardiello, and therefore, per an apparent County Wide policy (or practice), Major Jones was Lt. Nardiello's supervisor. Since Major Jones was a supervisor of Lt. Nardiello, was it appropriate for his (Jones) spouse to be involved in the investigative process? Ironically, doesn't Assistant County Attorney Nancye Jones memorialize such a County Wide policy / practice, in her argument given at the April 2012 Personnel Board hearing on another law enforcement employee? (see left of page - top video)

While VolusiaExposed has no evidence of wrongdoing by either of the Jones, we ask you, our readers - whether such, at the very least, has the appearance of impropriety? With that thought in mind, we request the you review the bottom video to the left of this web page. Listen to Attorney Jones' statements on how "perception is reality", and how these "perceptions" can damage management's ability to supervise.

VolusiaExposed.Com sent the below email to several Volusia County officials, in which we requested whether the perceived Jones / Jones conflict of interest would be a violation of HR BULLETIN 18.

As of the posting of this article, VolusiaExposed.Com has NOT been given a response to our email.
