INTRODUCTION
In some law enforcement agencies, the investigative process sometimes is more corrupt, then the corruption it has been assigned to investigate.


Recently (March 2013), VolusiaExposed.Com received an anonymous tip, that the VCSO had investigated whether a VCSO Sgt. S. Dwan had illegally used the D.A.V.I.D driver license data based for personal reasons.

Given Sheriff Johnson's February 22, 2013 testimony during the Deputy Travis Deane Personnel Board hearing, and our knowledge of VCSO Departmental policies, in particular Chapter 52.1, we (VolusiaExposed) realized that, if such allegations did exist, there should have been an official internal affairs investigation to properly document and determine whether such misconduct had occurred.

However, given how the "sex on duty" allegations against Deputy Sawicki were not apparently properly investigated or reported to the Florida Department of Law Enforcement, we (VolusiaExposed) were skeptical as to whether the VCSO had properly documented and investigated these allegations against Sgt. S. Dwan.

Sadly, it appears that, as in the Deputy Sawicki situation, the VCSO failed to follow their own investigative policies, in their "look see" into the allegations lodged against Sgt. Dwan.

The VCSO's failure to follow proper investigative procedures are failures in their (VCSO) responsibilities to Sgt. Dwan, the citizens of Volusia County and to the credibility of VCSO, as a whole.

"A system to review and investigate complaints and allegations is essential to establish and maintain the confidence of the Volusia County citizens, in order to protect the integrity / rights of the Department employees and to protect the public from misconduct." (Page 1 of VCSO Policy 52.1)










THE ALLEGATIONS

The anonymous allegations received by VolusiaExposed.Com alleged that VCSO Sgt. S. Dwan had developed suspicions that his spouse, DBPD Sgt. J. Dwan had engaged in a romantic affair with another Central Florida law enforcement officer.

That this alleged affair apparently developed during a recent training seminar. (66th Command Officers Development Course - held from October 2012 - February 2013 in Daytona Beach, Florida)

Sgt. David E. Spall of the Orange County Sheriff Department was the alleged second party to the suspected romantic affair.

The allegations also included the possibility that VCSO Sgt. S. Dwan had illegally searched the law enforcement data base, commonly known as D.A.V.I.D in an attempt to secure Sgt. Spall contact information.


THE "INVESTIGATION"
AKA - We (VCSO) looked into it


Recently and during the Deputy Travis Deane Personnel Board (February 22, 2013), Sheriff Johnson provided the below video taped testimony, that any personal usage of the D.A.V.I.D data based would open the VCSO to civil liability.

Therefore, as testified by Sheriff Johnson, one of the rationale's for investigating and terminating Deputy T. Deane was his alleged personal usage of the D.A.V.I.D data base, we made the below public record request for the Report of Investigation attached to the allegations against Deputy S. Dwan.

In the above email, the VCSO informed us, that they were aware of the allegations against Sgt. S. Dwan and that they "looked into" them and found the allegations "unfounded".



From October 2012 to February 2013, VCSO Deputy S. Dwan's spouse, Daytona Beach Police Department, Sgt. J. Dwan attended the Southern Police Institute's - Command Officers Development Course, in Daytona Beach, Florida.

Several other law enforcement officers attended this particular development course.

While we were relieved that the VCSO were already aware of the allegations against Sgt. Dwan, and that the VCSO had already "looked into" the allegations and determined them to be "unfounded", we were not convinced that a "looked into" equated to an investigation, as would be defined in Florida State Statutes and / or VCSO internal policies. Accordingly, we requested the investigative report that supported that the allegations were determined to be "unfounded".
(The term "unfounded" is an investigative finding supported in VCSO Policy 52.1.75 - see page 6)

The VCSO appears to advise us (VolusiaExposed) that no such ROI exists in the Sgt. Dwan matter. We invite our readers to review the entire VCSO Policy 52.1 - does this policy require that such documents be generated regarding the investigation of such allegations? We believe so !

In response to the above public record request, the VCSO provided us the two below linked emails. The first is where the VCSO emailed Florida State officials to determine whether anyone in the VCSO ran OCSO Deputy Spall's name through the D.A.V.I.D data based from October 2012 to early February 2013, along with the response from State officials.

The second email is VCSO forwarding this response to one of their own investigators.

While we (VolusiaExposed.Com) do agree that the below attached email appears to support that Sgt. Dwan did NOT abuse the D.A.V.I.D data base, we do NOT believe that the VCSO investigated / documented the allegations within their own policies (52.1).

Such failures to properly utilize their own procedures and policies, gives us pause, on whether criminal and or employee pre-employment background investigations are also being improperly processed.
