Of His Violation Of Probation Charge

READ: Why Emails With His Probation Officer
Were So Important In Clearing Him Of The VOP

"Facts are stubborn things; and whatever may be our wishes, our inclinations, or the dictates of our passions, they cannot alter the state of facts and evidence." - John Adams

Yesterday, (December 10, 2018), this publication attended and video recorded Brevard Corruption Watch's - Daniel Biro's violation of probation hearing. This hearing was held in Veira, Florida (Brevard County) in front of Circuit Court Judge Lisa Davidson.

For approximately six (6) years now - Biro has been battling the police, the State Attorney, the Court, and finally the probation office - in what he alleges to be a political frame up prosecution. Biro insists - and is willing to tell anyone that will listen - that he is an innocent man.

VolusiaExposed.Com came upon the Biro matter late in it's development - therefore we never formed an OPINION regarding the veracity of the criminal charges filed against Mr. Biro. However, we have maintained a post-conviction interest regarding Mr. Biro's journey through the Brevard County criminal justice system. Our initial interest was connected to his association with Brevard Corruption Watch.

VolusiaExposed.Com forwards the OPINION that Mr. Biro is a victim of harassment by members of the Brevard County Criminal Justice Community - this would INCLUDE the Court, the State Attorney's Office, the police, and based on today's hearing - particular attention is given to the probation office of the Florida Department of Corrections.

Probation Violation Not Sustained By Probation Officer's Testimony

In our OPINION - Judge Davidson opted not to sustain Mr. Biro's alleged violation of probation - due to the fact that Biro's probation officer's testimony conflicted with documents within Mr. Biro's probation case file.

In short, the probation officer verbally testified that he advised Biro to complete a task by August 2018 - but an email between Biro and the officer supported a September 2018 deadline*. The difference between the two months was a game changer regarding whether Biro had purposefully violated his probation. (WATCH THE ABOVE VIDEOS FOR PARTICULARS)

*The probation officer testified that his September 2018 reference in the email was a mistake - it should have been August 2018

Are Emails Also Exculpatory Evidence In The Pending
Dana Delaney Loyd Violation Of Probation Hearing?

Are The State Attorney's & The Probation Offices
Attempting To Hide The Evidence Pickle?

Since Dana Loyd's August 2015 arrest under the charge of filing a false abuse report with the Florida Abuse Hotline - VolusiaExposed.Com has published over thirty (30) articles - in which we voice our concerns and OPINION that Loyd's arrest had little to nothing to do with a phone call to the abuse hotline - and more to due with her exposing local law enforcement's history of covering up both in-custody sexual assaults, and at least one act of pedophilia by members of the local law enforcement community.

Up until her arrest / conviction - Loyd ran the media news site of BrevardsBestNews.Com. However, due to the terms of her rather strict, and in OUR OPINION illegal sentence - Loyd was forced to remove the news site from the Internet.

Regarding Her Email With Her Probation Officers

This publication was able to secure some email traffic between Loyd's probation officers - the State Attorney, and Loyd's alleged victim. We included these emails within our June 3, 2018 article.

Our June 3, 2018 article is of further interest - because our readers will be able to read the linked North Carolina law enforcement investigation / interview that helped convince Loyd that Brevard County law enforcement was ignoring these rather serious allegations. .

The June 3, 2018 article also incorporates an email - that appears to memorialize that the subject father (Loyd's alleged victim) had a personal social relationship with one of the Brevard County Sheriff's Office investigators. Finally, the article explores whether Loyd's probation officer filed a fraudulent probation violation report on her.

Recently, Loyd's attorneys filed for a copy of the emails received and sent by Loyd's probations officer(s) in reference to her probation supervision. Given the above - and now given the Biro VOP hearing - there is a reasonable suspicion - that these emails may provide Loyd with exculpatory evidence.

However, according to a recently filed Motion To Compel - the Department of Corrections has put Loyd's attorneys on notice that they can not seem to recover those emails.

So how was it that Biro's probation officer was able to cut and paste his emails within his violation of probation report - but Loyd's probation officers' emails are lost and not available for review?

Loyd has a 1 PM hearing today (December 11, 2018) on the Motion to Compel -- stand by to stand by --- there is surely more to come of this....
