As we reported earlier this month (October 2021), the Eighteenth Judicial Circuit confirmed with this publication, that as of this October 29th, Circuit Judge Jeffrey Mahl will be retiring.

The Scuttlebutt,
And What We Have
Suspected For Months


Starting in the very early Spring of 2021 - this publication started to receive some "scuttlebutt", that Judge Mahl was suspected of suffering from a cognitive decline.

Back in May of this year (2021 - see below right linked article), we reported our suspicions, that the judge attached to the Deputy Yousef Hafza criminal prosecution may be suffering from declining cognitive skills.

Brevard County Sheriff Deputy Yousef Hafza was on trial for the 2016 shooting death of Clarence Howard. The trial judge for that criminal prosecution was Circuit Court Judge Jeffrey Mahl.

The jury acquitted Deputy Hafza of killing Mr. Howard.

Just Gossip & Rumors?


Continuing into the summer, this publication continued receiving "scuttlebutt" that Judge Mahl was suffering from a spiraling cognitive decline.

A few examples of these rumours - included, but were NOT limited to Judge Mahl confusing which case he was then handling, or failing to properly dress for Court.

This publication kept a good eye on the Florida Judicial Qualifications (JQC) website - in the hopes, that IF the "scuttlebutt" was true, that Court officials would properly report this matter to the JQC.

In 2020, the Tenth Judicial Circuit had a similar concern regarding the mental health of Circuit Judge Neil Roddenbery.

The Tenth Judicial Circuit followed Florida State mandates and reported the Judge Roddenbery situation to the JQC.

The JQC - with the eventual approval of the Florida Supreme Court involuntarily retired Judge Roddenbery.

As is supported within an October 8, 2021 email communication - Court Public Information Officer (PIO) Michelle Kennedy advised this publication, that Chief Judge Jessica Recksiedler had NOT reported any concerns to the JQC regarding Judge Mahl.

Sure, PIO Kennedy's declaration that the chief judge had NOT advised the JQC of any concerns - could be an indicator that Judge Mahl's sudden retirement has no connections with cognitive decline issues.

However, within two emails - our October 8, 2021 AND our our October 6, 2021 - this publication invited PIO Kennedy to dispel these rumours that Judge Mahl is suffering from cognitive issues. Kennedy ignored our inquiries, and therefore, in our OPINION - she chose not to put those rumours to rest. Then again, maybe she could not put to rest - what is the truth?

Not Reporting The Inconvenient Truth


While this publication's concerns regarding Judge Mahl's retirement are largely supported with "scuttlebutt", Judge Recksiedler's past history, coupled with PIO Kennedy's refusal to refute, or to bring clarity to the issues - only goes to forward our concerns.

Records indicate that in 2015, the Florida Supreme Court reprimanded Judge Recksiedler for being less than truthful regarding her interviews (2013-2014) with the Florida Judicial Nominating Commission (JNC). Judge Recksiedler was attempting to secure a gubernatorial appointment to the 5th District Court of Appeal.

Basically, Judge Recksiedler lied to the JNC regarding her traffic tickets. So, from our perspective, we believe it is reasonable to question whether Judge Recksiedler is being totally truthful and transparent, regarding the circumstances surrounding Judge Mahl's sudden and quick retirement.

Additional Rumours Surface,
Are Judge Mahl's Recent Cases Being Reviewed?


Since we posted Judge Mahl's retirement letter - we have been advised (yes, scuttlebutt) that Court officials are considering reviewing some of Mahl's recently completed cases.

Further, we have received additional "scuttlebutt" that at least one judge is out due to COVID-19, and another judge is still actively serving on the bench - while receiving chemo treatments for cancer.

While some may argue that these judges' medical conditions are private matters - we would argue differently. These judges serve in "elected" positions - having the authority to sentence citizens to death. So, like the President of The United States, their health, and thereby their ability to serve, is of great public interest.

This publication is in agreement with Judge Mahl's retirement letter statement - which reads - "I have always had a firm belief in the fair and impartial judiciary our justice system promises".

But, how can a justice system be "fair and impartial" - IF that very same system is being less than transparent regarding the health and welfare of the persons entrusted to insure fairness, impartiality, and most of all justice?

And there you have it..... the rest of the story...as we currently understand it to be...please determine for yourself, whether the "scuttlebutt" rises to a level beyond mere rumours - or at the very least demands official and transparent answers.
